Terms of Use for CoPlay

These Terms of Use ("Terms") govern your use of the CoPlay service, in which a passenger curates destinations for a road trip and a driver sees a single destination and a single GO action. They apply in addition to the End User License Agreement (EULA) for the App. Where the EULA and these Terms overlap, both apply together; if there is a direct conflict about the software licence itself, the EULA prevails.

1. The service

CoPlay lets you create shared sessions for trips, add destinations, and hand a chosen destination to a maps app (Apple Maps, Google Maps, or Waze). Sessions are collaborative: several people can join the same session and add destinations from their own devices.

2. Accounts

You begin with an anonymous account, created automatically. You may optionally link the account to Sign in with Apple or Sign in with Google. You are responsible for keeping access to your account and for activity that takes place through it.

3. Session links are the access key

A session is joined through its link or QR code. In this version of the service, that link is the access secret for the session: anyone who has it can join the session and see and add its content, and there is no way to revoke a link or remove someone once it has been shared. Please treat a session link as sensitive. Share it only with people you want in the trip, and create a new session if you no longer want a previously shared link to grant access.

4. Acceptable use and conduct

You must use CoPlay in compliance with all applicable laws and regulations, in particular but not limited to road traffic and local driving laws and regulations. You are solely responsible for that compliance.

When using CoPlay you agree to:

a) use the service only for lawful purposes and in line with these Terms and the EULA;

b) add only content you are entitled to share, and not content that is unlawful, infringing, misleading, harassing, or offensive;

c) respect the other members of a session and their content;

d) not misuse, disrupt, overload, or attempt to gain unauthorised access to the service or its underlying infrastructure;

e) not use the service in a way that distracts from safe driving; curation is meant for passengers, and the driver's view is deliberately limited to a single destination and a single action.

5. Your content and responsibility

You are solely responsible for the sessions, session names, and destinations you create, including any titles, subtitles, addresses, coordinates, and links you add. We do not pre-screen content. Content you add to a shared session is visible to the other members of that session. We may remove content or restrict access where we reasonably believe it breaches these Terms or applicable law, or where we are legally required to do so.

6. Third-party services and data accuracy

CoPlay relies on services from Apple and Google and can open Apple Maps, Google Maps, or Waze. Map, place, and routing data are provided by those third parties. Your use of those services is governed by their own terms and privacy policies (Apple, Google, Waze), which are authoritative for how they work. We do not guarantee that any destination, address, coordinate, search result, or route is accurate, current, or safe. Always use your own judgement, especially while driving.

7. Availability and changes to the service

CoPlay is an early-stage service (version 0.1) provided free of charge. We may change, suspend, limit, or discontinue all or part of the service, and we may add or remove features, at any time. We do not guarantee that the service will be available without interruption or that data will be retained indefinitely. We will not unfairly disadvantage you as a paying customer, since the service is free.

8. Service provided "as is"

To the extent permitted by applicable law, the service is provided "as is" and "as available", without warranties of any kind. The disclaimers and the limitation of liability set out in the EULA apply equally to your use of the service under these Terms.

9. Termination

You may stop using the service at any time and can delete your account and data in the App. We may suspend or end your access to the service if you materially breach these Terms or the EULA, or where required by law.

10. Changes to these Terms

We may update these Terms to reflect changes to the service or to legal requirements. The current version will be made available with the App and on our website. Your continued use of the service after an update takes effect constitutes acceptance of the updated Terms, unless mandatory law requires your separate consent.

11. Governing law

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.
